Hi Christine,

As you will already be aware I have already filed an official complaint with the Data Protection Commissioner regarding the Halifax's use of the "Tick The Box" type of form which I believe deceives the data subject into limiting the scope of the rights given to him/her by an Act of Parliament. I am still awaiting the arrival of the data from the Halifax.

The Halifax in my case have also fabricated an untruth as an explanation for one of twenty-five acts of alleged negligence. They have also used feeble half-truths.

I would suggest that like me, you write immediately to the following:

Mr James R. Crosby Chief Executive Officer, Halifax PLC, Trinity Road, Halifax, HX1 2RG.

Explain your case to him. He is unlikely to be aware of it. Also refer to his statements in the "Sun City" column and especially his number one of top ten tips. (See Earlier Posting To This Forum re Halifax Quotes). Then ask for explanations of the falsification and erasure of the data received. Ask for an explanation of the untruth (See earlier Posting re: Halifax Untruth or Lie)of the statement regarding your husband's date of departure from the former marital home.

Explain to him that you already intend to send a formal complaint to the Data Protection Commissioner regarding the deceitful use of the "Tick The Box" form in a Subject Access Rights request. Then state that if you do not receive a satisfactory explanation of why the data was altered etc. you will be adding this to the complaint.
