I LIVE IN THE MATRIMONIAL HOME AND MY HUSBAND HAS REUESTED VOLUNTARY REPOSSESION, WHAT ARE MY RIGHTS?

from PAULA gUIREY (alphatrain@macc61.freeserve.co.uk)
My husband left the matrimonial home in January 2001. The mortgage is in his name only. I am still living in the house but have an interest registered under the Matrimonal Homes Act(Land Registry) Do the Abbey National have to issue an evection order to get me out of the property before they reposses ? and how much notice am I likely to get before I have to vacate ? I wish to buy the house, but my husband won't agree to me buying him out and the Abbey won't transfer the mortgage into my name. I can get a mortgage of my own. Do The Abbey National have to give me the first option to purchase the house before it is repossesed.? If the repossesion goes ahead I will buy the property after the repossesion. Is there anything I can do to avoid having to move out and then having to move back in again after the repossesion and me buying the house happens?
