Without 'Without Prejudice'

If you have a shortfall of say #30,000, and at some point in the 'blackmail' soryy negotiations the lender says we at this time are willing to accept #4,000 as a lump sum as full and final blah blah. If it went to court, and that letter did not have 'Without P...@ at the top would you be able to use this against them, or is it not that simple.
