I was ordered to pay an extra 100pounds a month on top of my mortgage payment I thought I had kept up the arrangement when I received a letter from the debt collectors saying that they were taking me to court for possession, when I phoned them to ask what was going on and they told me that I had not paid my mortgage payment, which I had sent to them in postal orders on the 4.10.00 I have since reported them missing and I am still waiting for a reply as to what has happened to them, they went on to say that I had until the 3.11.00 to pay which I agreed this was on the 16.10.00. Today I received a hand delivered letter from the court saying that the bailiffs will take possession of the property on 9.11.00 at 1.30pm.If I pay will that stop them coming? Sarah.

Firstly, who ordered you to pay #100 pcm, secondly, have you actually been to court? Letters from the court are generally only sent when there has been a case against you and bailiffs can only take possession with a possession order issued by the court. Jacky.

POst us some more info on your case. How did you agree the extra payments - with whom - the debt collectors or the court ? You can renegotiate your payments if #100 pcm was too ambitious on top of your other commitments. Maybe you made this under duress/pressure from the debt collectors just to make them leave you alone.

It's not over yet by any means - post some details asap.

Be strong and keep on pressing for your missing postal orders. Have they been cashed?

I was in a similar position regarding an unsecured debt and received threatening letters and telephone calls. In the end I persevered as the payments had gone from my bank account, only to find that the company had actually been crediting the payments to the wrong a/c. Even then I had to fight to get the extra charges taken off
