I have now had time to read the information recieved from the Halifax with regards to the Sujbect Data Access Notice we served and I can see that they have not sent the full Data as requested. According to the DIARY they have sent more letters than I have copies of, they have also made agreements with my husbands ex-wife but have not sent us copies but they have sent copies of notes made by a debt counceller that the Halifax sent to the house, they have tried to coverup some of the text of the diary, but some of it is still readable, as for all the dcopy invoices we have only recieved some for property maintenance and one of those goes back to 1997 and the property was repossed in Aug 1999, the HALIFAX ALSO STATE THAT THEY DID NOT KNOW THAT MY HUSBAND HAD MOVED OUT OF THE PROPERTY IN 1993 BUT THE DATE ON THE COUNCILLORS REPORT IS DATED JAN 1997 STATING THAT SHE HAS REMARRIED AND IS NOW KNOWN AS MRS.!!! AND LIVES WITH HER NEW HUSBAND. There is also an amended entry on the very first page and that correspondes withthe date my husband changed the address to my address and his shares cheque was sent to his new address.

DO I COMPLAIN TO THE HALIFAX AND ASK THEM WHY THESE THINGS HAVE BEEN ALTERED OR MISSED OUT, OR DO I JUST COMPLAIN TO THE DPA

Hi Christine,

As you will already be aware I have already filed an official complaint with the Data Protection Commissioner regarding the Halifax's use of the "Tick The Box" type of form which I believe deceives the data subject into limiting the scope of the rights given to him/her by an Act of Parliament. I am still awaiting the arrival of the data from the Halifax.

The Halifax in my case have also fabricated an untruth as an explanation for one of twenty-five acts of alleged negligence. They have also used feeble half-truths.

I would suggest that like me, you write immediately to the following:

Mr James R. Crosby Chief Executive Officer, Halifax PLC, Trinity Road, Halifax, HX1 2RG.

Explain your case to him. He is unlikely to be aware of it. Also refer to his statements in the "Sun City" column and especially his number one of top ten tips. (See Earlier Posting To This Forum re Halifax Quotes). Then ask for explanations of the falsification and erasure of the data received. Ask for an explanation of the untruth (See earlier Posting re: Halifax Untruth or Lie)of the statement regarding your husband's date of departure from the former marital home.

Explain to him that you already intend to send a formal complaint to the Data Protection Commissioner regarding the deceitful use of the "Tick The Box" form in a Subject Access Rights request. Then state that if you do not receive a satisfactory explanation of why the data was altered etc. you will be adding this to the complaint.
