Thank you for the replies I have already received, however I still don't understand why I need to get a non religious marriage that did not take place in a church nullified. Please explain. Thank you Caro

Because marriage of a Baptized person is always a religious event. Marriage is in the realm of the Church, not only in the civil realm. When a marriage takes place no matter where or how it takes place. It is always a Man, a Woman and God! God is always there even in the courthouse, He may not be happy because He is not in His house, but He is involved never the less.
