legality of statement & assessment of fees

Is the below statement legal? This is a statement that Coutrywide Mortgage is sending to there customers. I saw a class action law suite on simular lines not to long ago.

Important: Beginning with your payment due in June 2001, you will be charged a $5.00 fee if you schedule a payment to be drafted during the last 1/3 of your grace period. For example, if your payment is due on the 1st of the month and you have 15 grace days, payments scheduled to be drafted on available draft dates from the 1st through the 10th would be free. However, if you schedule your payment to be drafted from the 11th through 16th, you will be charged a $5.00 fee. The $5.00 fee will be included in your draft. When the program is effective, your online coupon will be updated to clearly reflect the draft dates that are free for your account. See the FAQ's for more examples and additional information.
