Repossession After Filing Chapter 7 Bancruptcy

greenspun.com : LUSENET : Repossession : One Thread

I filed Chapter 7 Bancruptcy in June or July of last year. When listing my debts for the filing, I listed a car that I was subleasing through an agency from an individual. When listing the car I stated that I would like to continue paying for it. Since that time the car has been repossessed. In fact it was repossessed in February this year. Currently, I am being sued for what they term as expenses that total $2,500.

Is there anything that I can do at this point? Is there something that will allow me to add this to the list of debts to be dischargeded when I filed initially or am I stuck with this debt?

Hi Clarence - this is a site which deals with UK house repossessions and I am afraid a US Chapter 7 is out of our area of expertise (in general). However, I would advise you to get a fixed fee lawyer in your State to have a look at your listing, primarily because I understood that only the primary lessee can list goods on a Chapter 7 which under a lease agreement (and you are sub-leasing). I could be completely off base though, as my US legal knowledge (such as it is) is only lay-man acquired.
