Application to set aside not granted - what now?greenspun.com : LUSENET : Repossession : One Thread
Finally got response from the court this morning (have been waiting over a month) saying that our application to set aside was dismissed. Reason given was that "htere is no realistic challenge to the money claim as at the time it was sought and granted. The defendants case is concerned with events which have occurred subsequently - mainly the realisation of the security. That requires fesh proceedings". What exactly, in language I can understand, does that mean? My arguments were that the Bristol and West were not playng ball, failing to come up with docs, reply to letters etc. The judgement was originally granted for 57K in 1996 they are now claiming 27K. They are trying to get an attachment of earnings but I dont know whethter this has been granted yet or not. Any advice appreciated.
