HELP! We need to find a realestate attorney in Coalmont Tennessee!

Our closing date on the 77 acers of land in Coalmont TN is sheduled for 4-15. Out attorney here in SC has suggested that we need to hire an attorney for what he called title insurance. There is an easement going across the corner of the property so having someone there on our side sounds like a good idea. This will only be our 2nd. time moving and we did make some mistakes the first time around. On our first posting on this board some of you responded to being from that area. Could someone please recommend someone to help us with this? We would really appreciate it. The easement worries me. Its very rugged and only a 4-wheel drive can go across. Will we be responsible for maintaining that road for someone elses use?? Thanks in advance for any replies!! Michelle and Donald...

Those conditions will be spelled out in the easement wording. Anything that is agreed to (or has been in the past!) is possible, so that is why the title atterney is a real good idea.

Generally you need to allow clear access from the public road to this person's propery, and actual maintaining of the road is their responsibility. Of course, if you damage what they maintain somehow (dump lots of mud on the road when you cross, wash out part of it by diverting water, etc.) then it becomes a legal issue & will run through the courts & you will be screaming at each other for generations.... ;)

Or, if hay is growing on the road sides, who gets to cut & bale it for their livestock? You own the property, they own access rights on it's surface - who owns the hay? And so on.

But, generally, you only need to keep access available, and things are fine. Unless the fine print says otherwise.

Your SC attorney ought to be able to readily locate someone for you - there are excellent lawyer referral programs for all areas, and attys can sometimes move them quicker than others. You might also check title companies in that area - they will give sound advice regarding title insurance and decent lawyers. If you brought through a realtor, they might also provide some good resources. I worked for years - though no longer - as a real estate attorney in Vermont. I know folks hate us - personally, I think dentists deserve as bad a rap! - but a good real estate lawyer can provide a lot of peace of mind, particularly as regards issues like easements and so forth. Martindale-Hubbel used to have an online search for lawyers. You might also check ABA (American Bar Association) website, and Tennessee Bar Association. The TBA, actually, would probably be an excellent resource. Good luck, Sean

Check around for local title companies. They're cheaper than attorneys and do the same thing.
