MOJ's

greenspun.com : LUSENET : Repossession : One Thread

Is there anyone out there who can help with the following questions:

a) Can a Lender or Mortgagee (if you prefer) still chase you without an MOJ ?

b) If he can't, how long after the repossession can he still obtain an MOJ ?

c) How can one discover if one exists, can you contact the court for example to find out ?

d) Would the time limit be 12 years for an MOJ if we are talking about a Specialty debt ?

e) When would the MOJ run from ? From the date of the judgement or from (as the above Appeal Court Case seems to indicate) the date of sale of the property ?

f) Can an MOJ supercede the 12 year limitation period, e.g. if an MOJ was obtained 11 years 11 months after repossession (although that sounds pretty unlikely to me) ?

Thanks in advance, Mark.

In "e" above the Appeal Court case I refer to is "Times Newspapers Ltd v Chohan", I can supply a copy if required.
