A catholic/baptized man married a no religion/not baptized woman thru the Justice of Peace. Is marriage valid?

Does man need anullment to marry a catholic/baptized woman thru a catholic church?

I was told that since the 1st marriage was not thru church, then we didn't need an anullment? I'm confused.

Daniel, Any prior marriage must be annulled prior to a Sacramental Marriage. The case you cite is a "Lack of Form" annullment and is usually a fairly simple process, but it still must be judged null and void. Fr. Chris
