October 3, 2002 (AP) -- Five Atlanta-area voters have asked a federal court to throw out the results of the primary that ousted U-S Congresswoman Cynthia McKinney.

The suit was filed in U-S District Court in Atlanta today. It says McKinney was the victim of a te -- "malicious crossover" vote by Republicans that violated the Voting Rights Act.

The suit names -- among others -- Georgia Secretary of State Cathy Cox, the DeKalb and Gwinnett county elections supervisors and Denise Majette, the former judge who defeated McKinney.

The state does not require voters to register by party and allows them to vote in the primary of their choice. But the plaintiffs in the suit are asking the court to declare crossover votes unconstitutional and invalid, giving McKinney the victory.

McKinnney has blamed crossover votes for her ouster in the August 20th primary.

Secretary of state spokesman Chris Riggall says he's unaware of any provision of law that forbids citizens from choosing which primary to vote in.
