Mother Could Return As Trial Witness

POSTED: 7:51 a.m. EST December 13, 2002

SEATTLE -- The mother of accused sniper suspect John Lee Malvo has been deported to her native Jamaica.

The Seattle Times reports that 38-year-old Una James was picked up by Immigration and Naturalization Service officials on Tuesday and was sent home Thursday night. James entered the country illegally in 2000 and has been living outside Seattle since then.

Lawyers for James said that she decided not to appeal the deportation order, which was issued last month. James may be allowed back in the United States when her son goes to trial.

Malvo, 17, and 41-year-old John Allen Muhammad are accused in a series of deadly shooting across the United States. Fourteen took place in the Washington area and 10 were fatal. Malvo and Muhammad were arrested in October.

Officials will decide in January whether Malvo will be charged as an adult and face the death penalty.
