Written judgment is expected in open court in Manchester on 3 April 2003 that could see thousands of borrowers' loans being determined unenforceable.

Leave to appeal has already been granted. Whichever party loses it is envisaged that an application to the Court of Appeal will be made in 2 years.

In the meantime however favourable without prejudice offers are being made to borrower members of our sister group National Association of Mortgage Victims which in many cases go far beyond the original endeavours to secure a refund of 'secret' commissions.

These settlements affect loans with City Mortgage Corporation, J & J Securities, OCWEN and I Group amongst others.

If you

• had a J & J Securities loan prior to 1996.

• have redeemed a CMC loan serviced by Ocwen or CMR loans.

• still have a loan taken out prior to April 1998 with CMC or one of its many subsidiaries.
