Does non-Catholic seek annulment in his own religion

I am a catholic that has never been married but wish to marry a non-catholic christian who is divorced. If we want to marry in a catholic church I believe he would need to have his marriage declared null. Would he apply for this annulment through his own church, or through my church where we hope to get married? Many thanks for your help.

He would need to apply for an annulment through the Catholic Church. Current canon law does not recognize annulments from any other denominations. Your church would be a good place to start; however, if he lives in another diocese than you, he may need to apply in the diocese where he lives.
