Importance of Mortgage Deeds

Hi All,

I'm being pursued by the Woolwich/CIS for an alleged shortfall debt on a repossessed property. I have followed the advice on this site and sarn'd every involved.

I have also requested a copy of the mortgage deed from the Woolwich (talk to organ grinder rather than the monkies) but so far have not heard from them. As I understand from information on this site, without a copy of this deed they have no basis for pursuing me for this alleged debt. Is this correct? If so, should I write and tell them this?

AS far as I know this remains a legally unresolved question. But others may be more up to date.

The person who was most closely tracking was Carol Riley at: National Association of Mortgage Victims. Might be worth checking with them. Please report back if you get more up to date info.

I think Lee is referring to the statutory provisions as per Section 2 of the Law of Property (Miscellaneous Provisions) Act 1989 which came into force for all mortgages after 27th September 1989. If your mortgage was before this date then the provsions of the 1925 Law of Property Act apply.

Sorry Mike - Due to a shortage of space, and time, this 'large Act' would be impossible to 'explain - I would respectfully suggest you obtain a copy from your nearest Law Library,or other outlet.

To short circuit the request - why do you need it explained ?

Okay, fine - when was your alleged mortgage taken out ? What type - repayment or endowment ? Term ? etc ? - I will then do what I can to try and point you in the right direction wherever possible ? At least let's narrow the field down - first !
