debt dropped by Abbey

greenspun.com : LUSENET : Repossession : One Thread

received a letter from eversheds today stating that Abbey 'have reviewed the file...and it is not in the interest of either party to pursue this matter any further.'

Seven years after repo and three years of evesheds on my case i have finally beaten them without having to pay any of the claimed £14k shortfall. It has taken a lot of letters, arguing my case, sticking to my guns, a thick skin, a belief in the information you have provided, and the convincing of my wife that this was the right way to go, but....boy was it worth it!

I have used only this site as my advice line and believe it came down to the fact that Abbey could not proove/produce/find the documents I was entitled to ask for in evidencing their claim.

I am not a legal expert or particularly clued up in this area but your site gave me all I need to know....many many thanks to the people who run and contribute to this site.

Although i'm still not really sure what I did I am happy to provide any advice or help that I can for others.

Good luck to you all.....never give in!

Well done Andy,

I haven't visited the site much since last November when the Halifax accepted my offer of £500 against an alleged £30K debt which had been going on for 8 years.

Your message was the first one I saw and what fabulous news. It just goes to show what can be done by digging your heels in and sticking to your guns, asking for proof and not backing down when they say you are wrong to ask.

Don't forget to keep all the letters just in case this does come back to bite you on the bum in a couple of years time. In theory it shouldn't, but we all know how these financial organisations like to twist the law in their favour.

I hope you and your wife have a wonderful Christmas.

Well done.

Abbey must be feeling charitable recently for some reason as I too settled (on my terms) with them.

Hope this inspires everyone else to keep plodding on!

All the very best!

Moira
